1. PRICING, FIRST-CUT ADJUSTMENTS & ONGOING SERVICE TERMS

1.1 Initial Lawn Service Pricing Authority

a. HerbaLawn LLC reserves the full right to adjust pricing on the initial lawn service if the condition of the property requires additional labor, time, fuel usage, equipment wear, or staffing beyond what is considered a standard maintenance cut.

b. This includes, but is not limited to, excessively tall grass, severe overgrowth, heavy weeds, missed prior services, compacted grass, debris, unsafe mowing conditions, or any circumstance that increases labor, fuel consumption, or risk to equipment or personnel.

c. Customers acknowledge that the first lawn service functions as an evaluation and recovery cut, and that all pricing shown online reflects typical, regularly maintained lawn conditions only.

d. Any pricing adjustment on the first cut is determined solely at the discretion of HerbaLawn LLC based on real-time property conditions observed on arrival or during service.

1.2 Fixed Pricing After First Lawn Cut

a. After completion of the initial lawn service, pricing for future services may be locked at the advertised online rate only if the customer continues service without missing scheduled appointments.

b. Weather-related delays initiated by HerbaLawn LLC, including rain, storms, or unsafe ground conditions, do not count as missed appointments and do not affect locked-in pricing.

c. Fixed pricing is conditional upon consistent service continuity and property maintenance.

1.3 Customer-Requested Rescheduling

a. If a customer requests to move, skip, delay, or reschedule a service for reasons unrelated to weather, a minimum of three (3) days’ notice is required.

b. Failure to provide proper notice may result in pricing adjustments on the next visit due to increased growth, labor time, fuel usage, and equipment strain.

c. Pricing adjustments under this section are determined solely by HerbaLawn LLC.

2. PAYMENTS, CARD ON FILE AUTHORIZATION & RECEIPTS

2.1 Payment Timing

a. Payment for lawn services is due immediately upon completion of each service visit.

b. Customers enrolled in recurring services authorize HerbaLawn LLC to automatically charge the payment method on file following each completed service.

2.2 Payment Method Changes & Re-Authorization

a. If pricing changes due to missed appointments, one-time services, overgrown conditions, or service scope changes, the previously stored payment method may no longer be valid.

b. In such cases, payment must be re-authorized by the customer or completed using HerbaLawn LLC’s tap-to-pay system powered by Stripe, which is built into company mobile devices.

c. A valid email address is required for all transactions in order to provide electronic receipts and payment confirmations.

3. TREE SERVICES, CONTRACTS & INVOICING REQUIREMENTS

3.1 Contract Requirement

a. All tree services, including but not limited to trimming, removals, haul-off, and specialty work, require a written contract and invoice prior to service commencement.

b. Tree service pricing is determined solely by HerbaLawn LLC after inspection and is based on labor requirements, equipment needs, access conditions, safety risks, and disposal considerations.

c. Receipts will be delivered electronically via email or text message upon payment.

3.2 Acreage & Complex Properties

a. Acreage properties, complex properties, and large-scale recurring services (weekly, bi-weekly, or monthly) may require custom contracts, regardless of any online pricing references.

4. TREE SERVICE PAYMENT STRUCTURE & AUTHORITY

4.1 Standard Payment Schedule

Unless otherwise agreed in writing, the following payment structure applies:

a. 15% deposit required to initiate work

b. 15% payment due once HerbaLawn LLC determines approximately 10% of the contracted work has been completed

c. 30% payment due once HerbaLawn LLC determines the project has reached the halfway point

d. Remaining 40% due immediately upon completion of the contracted scope of work

4.2 Alternative Payment Arrangement

a. At HerbaLawn LLC’s discretion, a 50% payment prior to starting and 50% upon completion may be approved.

4.3 Authority Over Progress & Completion

a. Progress milestones and job completion status are determined solely by HerbaLawn LLC based on the written contract scope.

b. Customer opinions, observations, or personal assessments do not override contractual definitions of progress or completion.

4.4 Add-Ons, Changes & Inability to Perform

a. Any additional work requested after a project has begun requires a separate quote and a new or revised contract.

b. If HerbaLawn LLC is unable to complete a portion of the contracted work due to safety concerns, access limitations, or unforeseen conditions, the company may cancel that portion or deduct the applicable cost.

c. Any such change will be documented through a revised agreement.

5. PROPERTY ACCESS, GATES, WAIT TIMES & MISSED ENTRY

5.1 Customer Responsibilities

a. Customers are responsible for ensuring clear and safe access to all service areas on the scheduled service date.

b. Gates must be unlocked and accessible prior to arrival.

5.2 Waiting Period

a. HerbaLawn LLC will wait up to fifteen (15) minutes for access to be provided.

5.3 Access Limitations

a. HerbaLawn LLC will not jump fences, climb gates, or cross obstacles exceeding two (2) feet in height.

b. If the front yard is accessible but the backyard is not, service will stop at the accessible area only.

5.4 Charges for No Access

a. If access is not provided, the full service amount may still be charged to cover reserved service time, labor scheduling, and operational costs.

b. For small and medium yards, pricing for the next scheduled visit will generally remain unchanged.

c. For large yards, acreage, or complex properties, pricing for subsequent visits may vary at HerbaLawn LLC’s discretion.

6. PETS & SAFETY POLICIES

6.1 Customer Responsibility for Pets

a. Customers are solely responsible for securing pets prior to service.

b. HerbaLawn LLC is not responsible for restraining, relocating, or managing pets.

6.2 Service Interruption Due to Pets

a. If a pet prevents service, the visit will be canceled and treated as a customer-initiated reschedule.

b. Resulting overgrowth may cause pricing adjustments on the next visit, which may increase up to twice the normal rate, depending on conditions.

6.3 Aggressive Animals

a. Any aggressive pet that bites personnel or damages equipment will result in immediate termination of services.

b. HerbaLawn LLC reserves the right to file insurance claims for equipment damage, repairs, or medical treatment.

7. PROPERTY CONDITIONS, TALL GRASS & HIDDEN HAZARDS

7.1 Yard Preparation

a. Customers are responsible for clearing yards of visible hazards, including but not limited to rocks, toys, trash, debris, wires, hoses, pipes, and similar objects.

7.2 Tall Grass & Limited Visibility

a. Excessively tall or overgrown grass limits visibility and increases risk.

b. HerbaLawn LLC is not responsible for damage to hidden, unmarked, or pre-existing items, including underground or obscured utilities or personal property.

7.3 One-Time & High-Risk Services

a. One-time mows or severely overgrown properties may require a limited liability acknowledgment or short-form contract prior to service.

b. This policy applies to all services offered by HerbaLawn LLC.

8. DEBRIS REMOVAL & ADDITIONAL FEES

8.1 Optional Debris Removal

a. Removal of sticks, trash, toys, rocks, or hazardous items may incur additional fees.

b. Repeated occurrences (more than three times) may result in repricing or service modification.

9. MULCH CALCULATOR DISCLAIMER

9.1 Estimation Purpose

a. The mulch calculator on herbalawn.com is a customer-use estimation tool only and reflects approximate material costs based on store pricing.

b. Taxes are not included.

9.2 Final Pricing

a. Labor, weed barrier installation, haul-off, and additional services are quoted separately and documented in writing.

10. REFUNDS & SERVICE QUALITY

10.1 Refund Eligibility

a. Refunds are considered only for material service errors, including more than ten (10) clear failures such as uncut areas, missed edging, or debris left in walkways, driveways, or service areas.

10.2 Exclusions

a. Minor imperfections, natural regrowth, and subjective preferences do not qualify.

b. HerbaLawn LLC is not responsible for debris landing on vehicles left within service areas.

11. RIGHT TO REFUSE OR TERMINATE SERVICE

11.1 Service Refusal

a. HerbaLawn LLC reserves the right to refuse, suspend, or terminate service due to unsafe conditions, non-payment, repeated access issues, aggressive behavior, or circumstances beyond reasonable control.
